What is a landfill and how would it affect my town?

  1. How do we know if the groundwater stays clean?
  2. Don't all liners leak?

  5. Won't there be a lot of traffic?
    • Gerhard/ALCEN: Traffic impacts will be evaluated for each of the proposed locations for the site. All though the facility has a planned capacity of 5,000 tpd, the actual rate is likely to be much less. The traffic count for the planned capacity is approximately 100 to 125 trips per day. Much of the material will arrive via rail.
    • Brant Citizens: Rail transportation is only economical over “long distances” where time is NOT of the essence. Indicating large volumes from NYC,CANADA..you name it coming into our community in “large” containers where many “HAZARDOUS” chemical could be “cocktailed” and not caught upon visual inspections. Also, at 20/tons per truck per day times 125 trucks per day = 2,500 tons left to arrive by rail per day !
  6. Will the traffic hurt our roads?
    • Gerhard/ALCEN;Any road upgrades and/or additional maintenance costs will be bore by the facility.
    • Brant Citizens: For how long?..At Who’s discretion?..What about neighboring towns roads we all use?..What about State and county roads, like Cain and Route 20 & 5 ? What roads are Gerhard talking about that the town maintains...Hammond?
  7. Are there other landfills by industrial parks?
    • Gerhard/ALCEN:Yes, Penington NY is the closest, which has High Acres Landfill.
    • Brant Citizens: Wow, Where is Brants Industrial Park? Do we want an Industrial Park? Will Gerhard/ALCEN build an Industrial Park?
  8. What will happen to the value of my home?
    • Gerhard/ALCEN:Values of the near by homes will be guaranteed through a property protection plan. Simply put, the present value without a SWMF is determined when the property owner decides to sell if they do not receive the value (adjusted for inflation) the facility would be responsible for the difference.
    • Brant Citizens: What about those who live neighboring the dump but not adjacent to it according to this proposal? Simple...They lose. What about those across the street in Evans?...Simple..They Lose. Besides if this dump is so great wouldn’t property values increase? Why not guarantee everyones property value in Brant and Evans then...if its all true..they couldn’t lose.
  9. What happens when the landfill closes?
    • Gerhard/ALCEN: The facility must be maintained and monitored for the post-closure period once the site has been closed. During this period the leachate generation and rate significantly reduces.
    • Brant Citizens: Then we have a manmade mountain of 1,000 acres that can NEVER be reclaimed again....No foundations can be built...Nothing that would ever disturb the “landfill cap”..FOREVER!
  10. Who pays for the long-term maintenance of the landfill?
    • Gerhard/ALCEN: Ans. Prior to opening the facility funding is put into place by the landfill operators.
    • Brant Citizens: A Maintenance Bond is placed with the state under there requirements to cover the state for any investigation/legal proceedings in the future...NOT FOR ANY REMEDIATION/CLEAN-UP WORK.
  11. Isn't landfill water (leachate) toxic?
    • Gerhard/ALCEN:Leachate generated by a typical SWMF is sent to a local waste water treatment facility. The strength of this liquid (measured by the types and concentrations of contaminants) is reported to the NYSDEC and the Sewer Treatment Plants. Data from lined facilities show the liquids to consist of "weak" concentrations, acceptable at most Sewer Treatment Plants and of lower toxicity than the liquid currently being processed.
    • Brant Citizens: Who’s treatment plant?...Evans?...These “WEAK TOXINS” are acceptable at MOST treatment plants? Can Evans Handle them?...Will they want to? If the toxicity is lower than currently being processed why would only MOST take them? How will these NEW WEAK TOXINS effect the effluent flow from local treatment plants to our #1 resource..Lake Erie.
  12. How will the landfill impact on the wildlife in the area?
    • Gerhard/ALCEN:During the preparation of the Environmental Impact Study, the wild life of the proposed facility will be evaluated. Any impacts to the wild life in the area will be mitigated either through design modifications or facility design changes.
    • Brant Citizens: Design Modifications and/or Facility Design Changes to mitigate impact on wildlife in the area will only be done if pressured by DEC. Any Change to a 1,000 acre site WILL EFFECT WILDLIFE.
  13. I remember the dump when I was a kid being full of rats and seagulls, what are new landfills like?
    • Gerhard/ALCEN:Vermin (rats, etc.) can not live in a modem landfill. Waste is compacted until there is not enough room for vermin to exist. Various methods are employed to successfully keep seagulls away from the site, these are many of the same means farmers use. The seagulls will not stay somewhere they can not land and feed. The closest facility to employ this successfully is Rodman Landfill near Watertown, NY
    • Brant Citizens: Surrounding this Dump Area is plenty of wooded and brushy areas which (with an available food source..ie garbage) WILL support and propagate large numbers of vermin (rats,gulls,etc.) in the surrounding areas.
  14. How does this project help the Town financially?
    • Gerhard/ALCEN:A positive economic impact of approximately $8,440,000.00 per year.
    • Brant Citizens: Yes, That Fuzzy Math...The Royalty Income estimate is based upon daily receipts of 80% of the Max capacity of 5,000 Tons per day. In Question #5 regarding Traffic Gerhard says”Although the facility has a planned capacity of 5,000 tpd, the actual rate is likely to be much less” Therefore, the royalty payments “much less” because they are “volume dependent” on a sliding scale ! (see proposal page 7)
  15. Can a landfill be placed over an aquifer?
    • Gerhard/ALCEN:A landfill cannot be built on a site if there is an aquifer under the proposed site. The existence of an aquifer can not be comprehensive proved or disproved until comprehensive hydro-geological studies are completed.
    • Brant Citizens: Just like the phrase “Double lined fills don’t leak” can not be proved until time and studies are completed. If liners would never have the chance to leak, why would aquifers even be a problem for them?
  16. Won't I see the site from every point in the Town?
    • Gerhard/ALCEN: A visual impact analysis will be prepared for the proposed facility. This analysis will be used to evaluate the view shed for the site. Where appropriate, screening will be design for the site to reduce and/or eliminate the visual impact.
    • Brant Citizens: Just like those beautiful communication towers that have been springing up everywhere. The Site planned for this dump is right between two major highways Route 20 and Route 5 it is hard to believe any screening will hide a 5,000 Tons per day dump.
  17. Will there be papers and garbage from loads on the road?
    • Gerhard/ALCEN: All waste loads entering the facility must be tarped. Each of the loads are inspected prior to crossing the scale to ensure they meet delivery criteria. Personnel from the site will have the specific task of policing the road to the site on a daily basis.
    • Brant Citizens: Why would “policing” be required on a daily basis if all trucks are tarped? Will Items "leak" Fall-Off or Fall-Through the vehicles? How far off the road will they go to collect this "spilled/blown away trash"? How many “personnel with this specific task” will it take to collect all this trash?


Just A Few Citizens Questions and Answers


  1. Section 2 page 2 paragraph 1 of Gerhard's proposal states that “no material placed in the cell will escape into the environment." Yet, on page 3, the proposal states that the "If you assume the same operating efficiency in the secondary liner as the primary liner (approximately 98 percent) the amount of drainage through the secondary system could be projected to approximately 60 gal. per day for a 150 acre site" Can Brant expect...IN THE BEST CASE...to be contaminated at a rate of 160 gallons a day, 4,800 gal. per month, 58,400 gal. per year, for this 400 acre non-leaking site?
  2. What if there is a leak in the liner and ground water contamination occurs?
  3. The proposal states that this facility will be “STATE OF THE ART” does that mean an "Anerobic Bioreactor Based" - State of The Art Landfill?
  4. Will, during construction, any “exceptions” to the NYSDEC code be applied for?
  5. What will be the additional cost to the town to implement checks/balances, inspectors, and increased infrastructure? Who will help pay when the site closes?
  6. The Proposal States this “landfill” will Not accept “Hazardous Waste”
    • Brant Citizens: Yes, under the definition of "RCRA" they cannot take hazardous waste. BUT, Hazardous Substances, Hazardous Materials (ie Asbestos, <50ppm PCB) and other “Special Wastes” are permitted. As well as many Hazardous Wastes generated by Households, exempted from being “HAZARDOUS WASTES” and placed into landfills everyday. Not to mention “small quantity hazardous waste generator” exemptions. Or those who intentionally mix or “cocktail” hazardous wastes/materials into “garbage” or other industrial “special” waste streams destined for Subtitle D landfill disposal.
